1. PrismArt's Role
PrismArt operates as a marketplace platform. We facilitate connections between artists, galleries, and buyers. PrismArt does not claim copyright ownership of artwork uploaded by users. Copyright remains with the original creator or rights holder.
2. Artist Copyright
Artists who upload work to PrismArt represent and warrant that they own or have appropriate rights to the artwork. By uploading, artists grant PrismArt a non-exclusive license to display and promote their work on the Platform for the purpose of facilitating transactions.
3. DMCA Notice & Takedown
PrismArt respects intellectual property rights and complies with the Digital Millennium Copyright Act (DMCA). If you believe content on PrismArt infringes your copyright, you may submit a DMCA takedown notice.
Your notice must include:
- Identification of the copyrighted work you claim is infringed
- Identification of the material on PrismArt that you claim is infringing, with sufficient detail for us to locate it
- Your contact information (name, address, email, phone)
- A statement that you have a good faith belief the use is not authorized by the copyright owner
- A statement, under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or authorized to act on their behalf
- Your physical or electronic signature
4. Where to Send Notices

5. Counter-Notification
If you believe your content was wrongly removed, you may submit a counter-notification with the following:
- Identification of the removed material and its location
- A statement under penalty of perjury that removal was a mistake or misidentification
- Your name, address, and phone number
- Consent to jurisdiction of the federal court in your district
- Your physical or electronic signature
6. Repeat Infringers
PrismArt will terminate the accounts of users who are determined to be repeat infringers. We may also take other appropriate action against repeat infringers.
7. Reporting Infringement
If you are not filing a formal DMCA notice but want to report a potential copyright issue, please contact us at copyright@prismart.app and we will investigate.
8. Licensing vs. Ownership
Transactions on PrismArt may involve licensing, rental, or purchase. Licensing and rental transactions grant specific usage rights but do not transfer copyright ownership. Only retail purchases transfer ownership of the physical work — copyright remains with the artist unless explicitly transferred in writing.
